SUV driver may face wrongful death suit after hitting pedestrian

Most people understand that driving is a privilege, not a right, and as such, licensed drivers need to do all they can to ensure they, their passengers and people they encounter along their route remain safe. This attention to safety includes not only obeying all traffic laws during the act of driving, but also avoiding mind-altering substances before driving.  Likely, all Colorado residents are fully aware of the dangers of driving under the influence of drugs and/or alcohol, but some still ignore the facts and indulge in these substances before getting behind the wheel. Too often, such an error in judgment leads to tragedy. The driver of a vehicle that killed a pedestrian is suspected of driving under the influence and, in addition to criminal charges, may also find himself facing a wrongful death lawsuit.

Car accidents: Driver in fatal hit-and-run sentenced to 18 years

It is probably safe to say that most Colorado drivers, if they became involved in a motor vehicle accident, would remain at the scene to take responsibility for their part, assist investigators and perhaps even offer help to others involved who may have been injured. In doing so, people show they are caring and compassionate and willing to be held accountable for their actions. However, not everyone reacts in such a way following a crash, and unfortunately, car accidents can bring out the worst in some people.

Head-on collision may result in wrongful death suit

Some Colorado drivers may have had the frightening experience of veering over the center line of a roadway and maybe even encountering oncoming traffic. This type of situation can happen for various reasons: driver fatigue or distraction, faulty vehicle mechanics or drug or alcohol use before driving. Fort Collins Police say they are investigating whether the latter was a factor in a crash that killed a woman, and if so, her family may consider pursuing a wrongful death lawsuit.
