Wrongful death suit possible in fatal Colorado accident

One person is dead and three more have been hospitalized following a serious accident in Denver. Colorado authorities have arrested a 25-year-old man in connection with the crash, after he allegedly fled the scene. Criminal charges have been filed, and the victims and their families will be entitled to file personal injury and wrongful death lawsuits against him as well. 

According to the accident report, around 2:13 a.m. on Sept. 14, a sedan driven by the now-accused man was traveling north on Colorado Boulevard at a high rate of speed when the accident occurred. His vehicle struck another car turning left on a solid green light with enough force to kill the 29-year-old driver of the other car. The man apparently then fled the scene on foot. 

Two female passengers in the vehicle suffered broken bones, and a third passenger -- a man -- suffered fractured ribs and internal bleeding. All three are expected to survive. The women apparently identified the driver who fled from his presence on Facebook, and also identified him in a lineup. The man stands charged with leaving the scene of a crash causing death and/or serious injury. 

If he is convicted, he could face jail time for his role in the fatal crash. As stated above, the family of the deceased driver as well as the surviving passengers are entitled under Colorado law to file civil suits against him. Wrongful death and personal injury claims require evidence of the man's negligence regarding the accident, which can be sourced from police evidence gathered at the scene and in the subsequent investigation.
