Colorado street racers could face wrongful death lawsuit

On Behalf of | Nov 14, 2018 | Wrongful Death

Street racing is dangerous. Instead of being discouraged the way texting while driving and driving under the influence are, street racing has actually become promoted by popular television shows. Some programs present it in a fun, careless light without serious consequences or dangers. But it is dangerous — not only for the racers, but also for others who share the roads. Two street racers in Colorado face criminal charges and also possibly a wrongful death lawsuit for the death of a man killed in an accident they caused recently.

A 64-year-old man was making a left turn in the early morning hours when he crossed into the path of two cars racing on the street. Although they were in a 35 mph speed zone, the two vehicles were going over 70 mph. One of the vehicles struck the man’s truck, causing him to be ejected from the vehicle. He died at the scene.

The driver of the car that struck the man’s truck was a 32-year-old woman. She had her young child in the car. Both mother and child were taken to the hospital with injuries that were not life-threatening. The 26-year-old male driver of the third vehicle was unhurt.

Both street racers have been arrested and charged with vehicular homicide. In addition to the criminal charges, the two may also face a civil claim. The fact that they were racing, which is clearly negligent behavior, could cause them to be held responsible for the accident and, therefore, his death.

In Colorado, the family of an accident victim has the option of filing a wrongful death claim against the party or parties believed responsible for the accident. Monies awarded to the victim’s family from a successfully navigated claim can help cover funeral and burial expenses. An experienced personal injury attorney can help identify the responsible parties, gather the appropriate evidence and pursue a claim through the civil justice system.
