Car accidents: Colorado man arrested for DUI

A man in Colorado Springs is under arrest following a serious accident that sent four people to local hospitals. The Colorado Springs Fire Department and police both responded to the crash, which involved two vehicles. As with many car accidents, the investigation took several hours. 

Police say a 32-year-old man was driving southbound around 1 p.m. the afternoon of March 15 in an SUV, using the left turn lane to pass other vehicles, when the accident occurred. He overshot the turn lane and drifted into oncoming traffic, striking a pickup truck head-on. The force of the impact totaled both vehicles. 

Emergency crews say they had to free several people from their vehicles. A total of four individuals were taken to local hospitals, three of whom were occupants of the pickup truck. Two were reported as being in serious condition, while the third was still under evaluation as of this report. The man believed responsible for the accident was also treated at a hospital before being arrested for DUI, vehicular assault and a traffic charge. 

In car accidents where drunk driving plays a role, criminal charges are usually filed by Colorado authorities. However, even if no charges are filed or no conviction is won, state law still allows the injured parties to use evidence of the man's negligence and intoxication to pursue personal injury suits against him in a civil court. The success of such suits is not contingent upon a criminal conviction, though evidence of negligence is necessary to prove that the defendant caused or materially contributed to the accident and the injuries that were suffered as a result.
