Man files wrongful death lawsuit against pot manufacturer

Lawsuits are filed for all kinds of reasons. When someone is injured or dies because of the negligence of another party, those affected may be entitled to file a wrongful death lawsuit. A Colorado man recently filed a wrongful death lawsuit against a marijuana store and a manufacturer of pot candy.

Nearly two years ago, a 911 dispatcher received a call from a woman, claiming her husband was hallucinating and acting crazy. She was able to tell the operator her husband had consumed some edible pot before she was heard screaming about a gun. Over 10 minutes had passed after the call originated, and police still had not arrived at the house. The operator heard a gunshot over the phone. The police finally arrived at the house to find the wife dead, a joint and some marijuana candy as well as the three children belonging to the couple.

After an original plea of not guilty to first-degree murder five months ago, the husband recently entered a guilty plea to second-degree murder. It is expected that he will be sentenced in March to as many as 30 years in prison and a fine as high as $1 million. He will also have to surrender custody of his children to his wife’s parents. He has filed a wrongful death lawsuit, claiming that the marijuana caused his delirious state. The suit asserts that there were no written directives to warn of the effects of the candy once consumed.
