Bad weather is often the reason for many car accidents during the winter months. Snow and ice can cause cars to slide all over the road, even when a driver is using the utmost caution. Add a driver whose senses have been impaired because of drug or alcohol consumption to the mix, and the potential for damaging car accidents increases. A Colorado woman who was seriously injured in an accident a few months ago has filed a suit against the 20-year-old man who allegedly caused the accident.
According to the suit, the woman was trying to slowly make her way down a highway during a blizzard when she was hit head-on by an SUV. Her injuries were so severe that she had to spend a week in intensive care and another two weeks in general care at a local hospital. Her suit includes the young man’s father, as he is the actual owner of the SUV that hit her.
Trooper reports state the uninjured man claimed he was going around 50 or 60 mph on the snowy road after he and a friend left the X Games. Alcohol, drugs and drug paraphernalia were found in the SUV, and he did admit that he had been drinking and smoking several hours earlier. While just slightly, his blood alcohol level was over the legal limit of .08 percent. He was charged with DUI and vehicular assault.
Those injured in car accidents similar to this one may feel the need to file personal injury lawsuits to recoup some of the financial losses incurred because of the accidents. Negligence will need to be proved according to the legal requirements of the state.
