Colorado mother files wrongful death lawsuit against ex-husband

A Colorado woman has accused her ex-husband of negligence which, according to her claims, led to the death of their son. She has filed a wrongful death lawsuit against him, which includes a claim for loss of consortium. A report on the wrongful death suit did not specify the amount she is seeking in damages.

The 13-year-old boy disappeared when he was visiting his father for the Thanksgiving holiday in 2012. His visit had been ordered by a court after the couple divorced. Searches by law enforcement and volunteers were continual after he vanished, and some of his bones were finally found — after approximately 18 months — just three miles from where the father lived at the time. The criminal investigation is ongoing.

The mother has always felt her ex-husband killed their son. The local sheriff’s office is not revealing at this time information on recent discoveries in the case but says they are working toward a conclusion to the case that will hopefully come in the near future. The ex-husband was reached by phone for a comment, though he apparently claimed he had not yet received any information on the lawsuit.

Should the Colorado wrongful death claim proceed to trial, the mother has requested a jury of 12 individuals to hear the case. The suit claims that the father should have provided proper parental care while the boy was in his custody. The mother asserts that he violated that responsibility because the death of their son stemmed from the father’s neglect. Through her attorney, the mother reserves the right to modify or amend her civil complaint depending upon the progress of the criminal investigation.
