Seeking damages against an aggressive driver

Aggressive driving is not at all unique to the state of Colorado. It is a problem everywhere. Generally speaking, you know it when you see it: trailing too close; cutting off other drivers; speeding, outraged gesticulation. In some ways, road rage could be somewhat comical, if it weren’t for the fact that it puts other motorists at serious risk of harm.

Unfortunately, police aren’t always around to witness aggressive driving. Here in Colorado, there is a program overseen by the Colorado State Patrol which allows motorists to report other drivers who engage in aggressive driving even when the behavior isn’t witnessed by a trooper. After three reports, the registered owner of the vehicle is notified of the behavior in the mail. After five reports, there is another warning letter delivered in person by a trooper. 

No charges are issued based on reports to the database, but it is one way that motorists can help put aggressive drivers on notice that their behavior is not acceptable. When an aggressive driver causes an accident that results in serious injury or death, of course, the victim and his or her family deserve to be adequately compensated for injuries and other damages.

Victims of road rage, in addition to economic and non-economic damages, may in some cases also be entitled to punitive damages. These are damages which are intended to punish the offending party in a civil content.
