Road conditions, speeding may have caused a fatal car accident

On Behalf of | Jan 18, 2015 | Wrongful Death

When the weather gets colder, icy roadways and other treacherous situations are often prevalent. These circumstances mandate that Colorado drivers use caution, obey posted speed limits and drive according to existing conditions. Unfortunately, some drivers are not as cautious, and those actions could result in serious injuries or even a fatal car accident.

During a recent morning, a driver lost control of his vehicle while traveling on I-25 close to Fountain. The vehicle crossed into the opposite lane of traffic and collided with a semi tractor that was hauling a trailer. The car hit the truck, went underneath the trailer and crashed into the rear axles. After rotating several times, it came to rest on the center median.

The car driver and his female passenger, ages 27 and 22, were both thrown from the vehicle. Both individuals passed away at the scene of the crash. Neither was wearing a seat belt. The semi driver was wearing a seat belt and was not hurt.

Colorado authorities believe that the driver of the car was traveling too quickly for the road conditions, and they have preliminarily cited that factor as the principal cause of the fatal car accident. The deceased passenger’s surviving family may choose to file a wrongful death claim against the estate of the deceased driver as well as any other party with an ownership interest in the vehicle. Any monetary judgment awarded by the court could help the grieving family with the burden of the end-of-life-expenses and other documented financial losses recognized under wrongful death laws.
