Many people want to believe that when they travel on the road that they will come back safe and sound. Unfortunately, a fatal car accident is becoming more of a common occurrence in Colorado and across our country. Tragically, another life has been taken due to a driving under the influence and reckless driving.
A 25-year-old man was driving on the roadway at almost 3:00 in the morning. Authorities indicate that the man was attempting to find the destination he was driving to using his GPS system. While not paying attention, his vehicle drifted into the median. Once he realized it, he over corrected causing the car to drift back into the median and flip.
One of the passengers, a 21-year-old woman, was thrown from the vehicle through the sunroof, and then crushed underneath the car. She was declared dead at the scene. A 21-year-old male who was also a passenger in the car sustained injuries serious enough to be taken to the hospital, but the extent of his injuries was not indicated. Reportedly, the driver had been drinking that night and was charged with DUI, reckless driving and vehicular homicide.
The fatal car accident has left one woman dead, one man in jail and a family in emotional turmoil. With regard to this case, the family of the woman has legal recourse under Colorado law and may be able to file a wrongful death claim against the driver. If it is determined that a wrongful death was brought forth by the negligence of another party, monetary compensation may be awarded.
